The Site is dedicated to providing news, features, comment boards, message boards, interactive forums, and merchandise for purchase.

Cinergi Interactive takes your privacy rights seriously and has posted this Privacy Policy to let our users know what information we collect from you, why we collect it and what we do with it. CI's goal is to collect and use only that information that we think is necessary for our legitimate business interests, such as to better understand and serve you (the community and fans), to provide better service, and to improve marketing of our services and products that we believe may be of interest to you.

Acceptance of These Terms

This Privacy Policy is incorporated into and is subject to the Cinergi Interactive Terms and Conditions of Use for the Site. If you do not agree to the terms of this Privacy Policy or the Terms and Conditions of Use for the Site, please do not provide us with any information and do not use the CI Site or the Site's services. Your continued use of the CI Site in light of changes to this Privacy Policy will signify your acceptance of the changes for information gathered after the date of the change.

Does this Privacy Policy apply to you?

This privacy policy covers CI's information collection and use practices for anyone who uses the Site. Except as otherwise set forth in this Privacy Policy, CI will not share your personally identifiable information with any third parties unless you give us permission to do so or except as required by law or to cooperate with law enforcement authorities.

This Site, however, contains links to other websites, advertisers and other third parties. By clicking on any of these links, you are leaving the Site. A link provided on the Site does not constitute an endorsement of the content, viewpoint, accuracy, opinions, policies, products, services or accessibility of that linked web site. CI has no control over the information collected from or about you by any third party after you have left the Site. This Privacy Policy does not cover the data collection and use practices of any third party linked to CI. Our company assumes no liability and is not responsible for any practices of such third party web sites, including their privacy practices, content, or other activities. Once you link to another web site from the Site, you are subject to the terms and conditions of that web site, including, but not limited to, its Internet privacy policy.

What information, including personally identifiable information, does CI collect from and about you?

In order to provide you with our services, there are two methods whereby we collect information from you: passive collection of technical information and information you voluntarily provide to CI, including personally identifiable information.

Passive Collection of Technical Information.

CI automatically collects certain technical information from each visitor, including your IP address, the type of browser you use to surf the Internet, your computer's operating system, and the web site from which you accessed the Site. Your IP address tells us both your Internet Service Provider (ISP) and the general geographic location from which you are connecting. We may also use your IP address to track how long you stayed on the Site and what pages you visited. This information is used internally by CI to help us provide a good web experience to our visitors, including providing proper formatting for our web pages and analyzing which aspects of the site are most effective.

In addition, CI uses Cookies on this Site. Cookies are small text files that are sent from a server computer to your computer during a browsing session so that the web site may track your activities on the web site and identify you on return visits. Cookies are typically stored on your computer's hard drive and are used by web sites to simulate a continuous connection to that site. Cookies, by themselves, do not necessarily let a web site know any personally identifying information about you, such as your real name, address, etc., unless you previously provided that information at the web site or have set your preferences in your browser to provide that information. CI is not generally interested in any one individual and does not collect personally identifiable information about any one person using Cookies. CI does, however, use Cookies to save your preferences so that the Site has the same appearance each time you access it. Most web browsers permit users to control the use of Cookies by refusing or deleting Cookies at any time. Refusing or deleting a Cookie may, however, limit your ability to take advantage of some features of this Site.

Information You Provide.

CI does not require anyone to register and become a member of www.cinergi-interactive.com to use the Site. Before you can use certain features of the Site, however, we do require that you register with the Site. If you register to take advantage of CI's membership benefits CI requires that you provide us with your ZIP code, city, username, and CI may require you to submit other information, including your email address, age, gender, and ethnicity. There is no requirement that your username be your real name. If you wish to preserve your privacy, we suggest that your user name not be your real name. If you elect not to register, you will not be able to access certain special features of the Site, such as comment boards, message boards, forums, and the tool kit function, and you may not upload content to the Site, but you will have access to the remainder of the Site.

Additionally, if during your visit to the Site, you complete a form such as a survey, a contest entry form, or an order form, you may be requested to submit certain personal information, which may include your name, address, and/or email address.

CI's use and disclosure of the information you provide us, including personally identifiable information is set forth below.

What other organizations besides CI may be collecting information from you on the Site?

CI may use outside advertising companies to display banner advertisements on the Site. Banner advertisements may also contain cookies, and appear to be coming from CI; but, in reality, they are coming from third parties who are serving advertisements on the Site. CI has no control over the privacy practices of any third party, and the manner in which any third party uses your information is not protected by the terms of this Privacy Policy. Further, once you leave the Site, CI does not control the privacy policies or the privacy practices of any third parties.

How will CI and its marketing partners use my information?

The information collected by CI is retained by CI and is used to better shape CI's marketing and other business activities and to operate CI's programs, which include the provision of goods, services, and information. CI compiles certain information in a database with the information collected from other Site users. This information may be disclosed by CI for those purposes that may be reasonably ascertained from the nature in which the information was submitted, which may include sharing information we collect, such as your email address, to our marketing partners, or to vendors who market products and services that we believe may be of interest to you. Once we share this information with third parties, their privacy polices and data collection and use practices govern the use of your information. CI is not responsible for the data collection practices and privacy policies of third parties. In addition to the uses of information described above, CI reserves the right to transfer information it collects to a successor, related entity, or to a third party purchasing or succeeding to any of CI's assets.

If you provide us with your email address, CI will send you email notices of upcoming Site events. When you provide your email address to the Site, you will have the opportunity to "opt-out" of receiving such email messages. Additionally, the email messages will provide a method whereby you may opt-out of receiving future emails from CI.

Further, if you order a product from CI, you may be directed to a separate web site where an e-commerce partner of CI will collect the information necessary to fulfill your order. This collection of information by CI's partner is governed by their privacy policy, and CI is not responsible for their data collection and use practices.

How can you change information submitted to the Site or opt out of the Site's activities?

You may edit the registration information that is associated with your username and email address by following the procedures outlined on the Site.

Further, as mentioned above, you may opt-out of receiving emails from the Site when you submit your email address and by following the procedures outlined in each email.

The third parties with whom we share information may or may not have their own policies that allow you to opt-in or opt-out of certain uses of your information.

What kinds of security procedures are in place to protect the loss, misuse or alteration of information under CI's control?

CI uses industry standard security measures to protect the loss, misuse and alteration of the information under our control, including encryption and a secure server and other security measures. Nonetheless, due to the inherent dangers of the Internet, we cannot guarantee the protection of such information against loss, misuse, or alteration.

Additionally, we provide an opportunity for our registered users to communicate and interact through our comment boards, message boards and forums, and through private messaging in the forums and chat rooms. We may monitor the message boards with CI employees, with comprehensive obscenity filters, and with message board administrators to ensure that these communications run smoothly. We will remove inappropriate content when we are notified of its existence, and our message board administrators will have the power to delete abusive or inappropriate postings or users. We may also ban the user or the user's IP address who posted abusive or inappropriate postings.

A special notice to parents of children under the age of 13.

The Site is a general audience web site and is intended to be used by adults interested in our company. It is not intended for children and CI does not want to collect any personally identifiable information for users who are under the age of 18. The safety of children is very important to CI, and CI recommends that parents review this Privacy Policy and understand its terms, so that this Site is used only by persons age 18 and over.

CI reserves the right, at our discretion, to change, modify, add or remove portions of this Privacy Policy at any time to comply with any applicable state or federal regulations, to utilize new technologies or to improve your CI experience, so please check back periodically to review our Privacy Policy. If CI changes any portion of this Privacy Policy, the change will be posted in this document so that you will always know what information we gather, how we might use that information, and to whom we will disclose it. CI will not change the use and dissemination practices related to information obtained under a prior version of this Privacy Policy without your prior consent. Please be sure to check this page periodically for changes. This Privacy Policy was last changed and posted on our Site on May 13, 2005.
